Clever Dog Design – Hosting & Security Services Agreement

Overview

The Universal Terms of Service Agreement (“the Agreement”) sets forth the general terms and conditions of your use of the Site and the Services. This Hosting and Security Services Agreement (“Service Agreement”) governs your use of Clever Dog Design’s Hosting services (“Hosting Services”) and certain security services. Capitalized terms used, but not defined, in this Service Agreement, are defined in the Agreement.

1. DESCRIPTION OF SERVICES

Web Hosting: Web Hosting plans place your site within one or more servers. Resources are shared between many customers on the same servers; however, your site is given a unique address (DNS).

Business Hosting: Managed Hosting plans provide the benefits of VPS or Dedicated Server environments while we manage setup, control panels, patching cycles, and backups.

Managed Hosting for WordPress: Includes WordPress installation, automated daily backups, core updates, and server-level caching.

Virtual Private Server (VPS): Shared server environment with full control, root access, and dedicated IP address.

Dedicated Server: Exclusive server allocation with full control of bandwidth, memory, and storage.

Managed Support: Monthly subscription covering patching, security, monitoring, and backups. Additional work may incur fees.

Fully Managed Support: Includes all managed services plus additional expert-level support.

Expert Services: Custom support services for advanced server tasks available at additional cost.

Hosting Backup: Daily cloud backups subject to storage limits. Backup services terminate when hosting services are cancelled.

3. ACCOUNT TERMINATION; LIMITATIONS

Migration of Servers

You acknowledge that server migrations may occur and IP addresses may change. No guarantee is made regarding retention of assigned IP addresses.

Cancellation, Renewal and Decommissioning

You must provide not less than thirty (30) days’ prior written notice to cancel any Hosting Services. Notice must be submitted via email or an approved written support channel. Verbal notice, informal communication, or non-use of services does not constitute valid notice.

If valid written notice is not received at least thirty (30) days prior to the next renewal date, the Hosting Services will automatically renew, and all associated fees will remain due and payable in full.

You acknowledge and agree that server resources, infrastructure, licensing, backups, monitoring, and administrative capacity are allocated in advance based on continued service.

Domain Transfer Requests and Administration Fee

All outbound domain transfers incur a $75 AUD Domain Transfer Administration Fee per domain. This fee must be paid in full prior to the release of EPP codes, domain unlocking, or any transfer assistance.

Deregistration and Data Removal Fee

Upon termination, all hosted data will be permanently deleted and server resources decommissioned.

A $150 AUD Deregistration and Data Removal Fee applies to cover administrative and technical processes required to complete this work. This fee is non-refundable and payable upon termination.

Termination of Hosting Services

Upon termination, you must discontinue use of the Hosting Services and remove DNS from Clever Dog Design servers.

You are solely responsible for migrating your data prior to cancellation. Clever Dog Design will not transfer, export, or provide copies of website or server content after termination.

Failure to migrate data prior to cancellation will result in permanent deletion of all hosted content.

Failure to Pay Outstanding Fees

Clever Dog Design reserves the right to refuse or delay cancellations, domain transfers, release of transfer credentials, decommissioning, or deletion of hosted data until all outstanding fees and charges are paid in full.

Free Products Credits

All included free products will be cancelled upon termination.

Licensed Images on Migration

You are responsible for ensuring continued licensing rights for any images after migration. Clever Dog Design holds no liability for usage after migration or termination.

Storage Capacity

Actual usable storage capacity may differ due to system requirements. Backup plans may include storage limits.

Support and Functionality

Support for end-of-life software may be provided at Clever Dog Design’s discretion, with or without additional fees.

Non-payment of Accounts

Unpaid accounts will be suspended. A $150 AUD reconnection fee applies to reinstate services.

If payment is not received within seven (7) days, data will be archived to offline storage. Restoration of archived data will incur a $150 AUD recovery fee.

Data may be permanently deleted after one (1) year.

4. YOUR OBLIGATIONS

You are responsible for:

  • Maintaining backups
  • Securing your data
  • Managing access and permissions
  • Ensuring legal compliance

Clever Dog Design is not liable for data loss.

You may not:

  • Abuse server resources
  • Engage in malicious activity
  • Use services for prohibited content

We reserve the right to suspend or terminate services for violations.

5. HOSTING LIMITATIONS

Hosting services include limits on:

  • Storage
  • CPU usage
  • RAM
  • Database size
  • Email sending limits

Exceeding limits may result in suspension, throttling, or required plan upgrades.

6. VPS & DEDICATED HOSTING

Includes:

  • Server access permissions
  • IP allocation rules
  • Backup options
  • Configuration add-ons

7. MANAGED SSL

Private keys will not be released under any circumstances.

SSL certificates are managed and renewed automatically where applicable.

8. SUPPORT SERVICES

All support services are provided on a “best effort” basis.

Expert Services are non-refundable.

Clever Dog Design is not responsible for third-party software issues beyond initial setup.

9. SERVICE UPTIME GUARANTEE

A 99.9% uptime target is provided.

If this target is not met, a 5% service credit may be issued. Credits are non-cash and apply only to future services.

10. NORTON PRODUCTS

Use of Norton products is subject to their respective licensing agreements.

Clever Dog Design is responsible for billing and customer support related to these products.

11. THIRD PARTY SOFTWARE

Use of third-party software is subject to the respective third-party licensing terms.

Clever Dog Design is not liable for performance, security, or reliability of third-party software.
